1.1. These Terms of Use for the Incubase platform (hereinafter "Terms") govern the rights and obligations of users when using the online Incubase platform designed for managing, entering, analyzing, sharing and utilizing data on bird egg incubation and related records.
1.2. By registering and using Incubase, the user confirms that they have read and understood these Terms and agree to be bound by them.
1.3. Incubase serves as a professional data and analytical platform for breeders, institutions, researchers and other authorized users.
1.4. For the purposes of these Terms:
2.1. Some parts of Incubase may be accessible without registration. These are publicly available aggregate outputs in the section called Incupedia.
2.2. Registration of a user account is required for data entry, access to non-public parts of the database, data requests and use of internal Incubase functions.
2.3. The user must provide truthful, accurate and current information upon registration.
2.4. The user is responsible for securing access credentials to their account and must not allow unauthorized persons access to their account.
2.5. The operator reserves the right to suspend or terminate an account if the user violates these Terms or uses Incubase in violation of its intended purpose.
2.6. If the user discovers misuse of their account, they must immediately report it to bergfzp@gmail.com. The operator will take appropriate action and inform the user of further steps.
3.1. The user must enter data truthfully, accurately and completely to the best of their knowledge and belief.
3.2. The user must not intentionally enter false, fictitious, misleading or otherwise defective data into Incubase.
3.3. The user is responsible for ensuring that the data, photographs and other content they upload to Incubase is authorized by them and that uploading it does not violate third-party rights or statutory regulations.
3.4. The user (or the institution administrator in case of multiple users from one institution) providing data to Incubase declares that all submitted data has been obtained in compliance with applicable national legislation and relevant international treaties, in particular rules governing legal possession, breeding, movement and protection of animals, including provisions related to the CITES Convention where applicable.
3.5. If the user uploads data on behalf of an institution, they confirm that they are authorized by the institution to do so.
4.1. Primary data submitted to Incubase remains the property of the data provider or institution that provided it.
4.2. The Incubase operator provides infrastructure for data management, analysis and sharing but does not assume ownership of primary data.
4.3. The institution is responsible for setting the licensing regime for its data and deciding the extent to which data will be made available to other users.
4.4. Upon termination of an institutional account, submitted data remains part of the database according to the licensing regime in effect at the time of account termination.
5.1. Each dataset or record set in Incubase may be made available in one of the following modes:
5.2. The user must always respect the licensing regime set by the data provider when accessing and further using data.
5.3. The data provider may determine that their submitted data will be temporarily hidden in full for a limited period. In such case, the data will not be available to other users during the period of confidentiality and will not be included in public aggregate outputs of Incupedia.
5.4. Changes to the licensing regime are effective only prospectively. The new regime does not apply to data already validly acquired by third parties.
6.1. The user acknowledges and agrees that data submitted to Incubase may, if not temporarily hidden in full, be automatically used to generate aggregate statistics, analytical outputs, visualizations and species summaries in the Incupedia section.
6.2. These outputs are generated automatically or semi-automatically based on methodologies described in the Incubase methodological manual.
6.3. If the user uploads photographs, they agree that selected photographs may be used to illustrate relevant species cards or other Incupedia outputs if the egg is not marked as temporarily hidden.
6.4. Photographs are standard published in Incubase with the author and institution credited.
7.1. A user who uses data from Incubase for the preparation of a scientific publication, professional article, report, recommendation or other public output must:
7.2. If a dataset requires an individual agreement with the data provider, the user must enter into such an agreement before further using the data.
7.3. Mere display or availability of data in Incubase does not automatically grant the right to use such data outside the conditions set by its license.
8.1. All aggregate outputs, recommendations, graphs and other analytical tools in Incubase represent interpretations of primary data according to the Incubase methodological manual.
8.2. The user acknowledges that the quality and reliability of these outputs depends on the quality, completeness and representativeness of available primary data.
8.3. The Incubase operator is not responsible for the correctness, completeness or biological interpretation of primary data submitted by users or institutions.
8.4. The Incubase operator is further not responsible for damages, losses or other consequences arising from the use or misinterpretation of outputs, recommendations or data available in Incubase.
8.5. Incubase is a professional support tool. Final decisions in breeding, veterinary, research or management practice are the user's responsibility.
8.6. The operator does not guarantee uninterrupted platform availability and may temporarily suspend operations for technical or operational reasons. Planned outages are communicated to users with reasonable notice.
9.1. Users may only upload photographs and other content to Incubase that they have the necessary rights to and that they are authorized to allow to be used in Incubase.
9.2. The user is responsible for ensuring that uploaded content does not violate copyright, personality rights or other third-party rights.
9.3. The operator is authorized to remove content that is clearly unlawful, false, inappropriate, duplicate or unrelated to the purpose of Incubase.
10.1. Users must not use Incubase in a manner that:
11.1. The operator is authorized to send users operational and important information messages at their registered email address relating to Incubase operation, account security, service changes, data requests, licensing changes or platform availability.
11.2. If the user is an institution administrator, they agree that their contact email may be used for communication regarding data access requests, institutional account management and related organizational matters.
11.3. Sending of newsletters, development summaries or other non-essential information beyond necessary operational communications is governed by separate user consent.
12.1. Information on how Incubase processes user personal data is contained in the Personal Data Processing Policy document, which is integral to the use of Incubase.
12.2. The user acknowledges that basic identification and contact data processing is necessary for account operation.
12.3. The user commits not to enter personal data of third parties into Incubase unless necessary for the platform's purpose and unless they have appropriate authorization and have fulfilled information obligations.
13.1. Incubase may use cookies necessary for proper service operation or to remember user language settings in accordance with the operator's terms of use.
13.2. Details about cookie usage are provided in the separate cookie information.
14.1. The operator reserves the right to modify these Terms to a reasonable extent, particularly if there are changes to Incubase functionality, legal requirements or service delivery methods.
14.2. Users will be informed of material changes in an appropriate manner.
15.1. These Terms are governed by the law of the Czech Republic and applicable European Union regulations.
15.2. If any provision of these Terms becomes invalid or unenforceable, it does not affect the validity of other provisions.
